Since you never got an H1-B stamped in your passport, you are not eligible for AVR (since there is no H1B visa to revalidate). You could do AVR for F-1 since you have that stamp but that is also NOT VIABLE any more because you are now not eligible/admissible for F-1.
So your choices are:
1. Come back in with AP (safest)
2. Go for H1-B stamping (approved, you come in with H1-B/ denied you come in with AP)
Both have their Pros and Cons.
Good luck and PS: There have been few people who got RFE because of Canada Landing. When you get the RFE, you have to again prove your intent of immigrating to US. You can show that by a sworn affadavit of your intent to settle in US. Additional, you can show employment ties, property etc. etc. Like we need to show ties to home country before F-1 or other strictly non immigrant visa interview.
But most people who have landed in Canada have had no issues.

Please dont mix priority date with quota.
spouse's priority date will be the same as primary priority date.
We are discussing about quota here.
Lets say I have PD of Aug 2007 and If govt makes me to file under EB and my wife under FB. When date becomes current in EB ( which has higer probability ) I will be able to file but my wife will not.
Now questions will be what will be her status ? If I switch to EAD ? second if govt give them a legal status but they have to wait for 3-4 years to date become current and file for 485.

Can we also try to involve some professional organisations like, TIE here and NASSCOM there. Indian government should also atleast give feelers to US govt for this unjust move, even if they cannot abolish per country quota, they can atleast make it depending on few parameters:

Hi Gurus,
I was looking at the processing times for the NSC 485 applications and it shows March , 2007.
Does it mean that all June 1st filers will be getting their 485 approvals by September ( barring any RFE and name check delays)???
Or is it Wishful Thinking???
It would be great if we kept this thread for receipt issues only but..
Please read the Ombudsmans 2007 report pgs 17-21. These are not real processing times.
BTW, I can't believe there are *still* people on this forum who haven't read this report -- it spells out absolutely everything that is going on/wrong with all our greencards, and you can't be bothered to read it?? :cool:

Has the issue of waiting times before being eligible to apply for citizenship been raised at all by Immigration Voice?? Currently one needs to wait for 5 years after being granted permanent status to be eligible to apply for citizenship. Now, considering the current backlog and the fact that Congress has mandated processing times to be much less than what we are experiencing, has the issue of getting credit for the lost backlog years in the citizenship process been raised? As I explained it to a friend the other day: This is becoming a retirement program - over 5 years at labor cert + another 4 at USCIS + 5 years waiting period + 3 years citizenship process = 0ver 17 years before we can cast a vote in this nation to which we contribute economically, intellectually, and socially. Not to forget that we are the ones doing things by the book and following the law on immigration.
